“Naftogaz” will not remove the claim and to cancel the claims to “Gazprom”

“Naftogaz of Ukraine” considers it justified its two lawsuit against Gazprom in the Stockholm arbitration, does not intend to cancel them and expects to win both, said the commercial Director of NAC Yuriy Vitrenko in response to the statement, the Russian foreign Ministry on the conditions of preservation of Russian gas transit through Ukraine.

“No one to remove the claim and cancel is absolutely reasonable claims in respect of “Gazprom” will not”, – he wrote on his page on Facebook on Wednesday evening.

Vitrenko reminded that the claim of “Naftogaz” in the Stockholm arbitration on the contract for the sale of gas was justified, and the requirements of the Ukrainian company have been satisfied.

“Our claim for the transit of no less justified. So won one lawsuit, we expect to win and in the second suit,” said he.

Earlier Wednesday, the Russian foreign Ministry stated that “the preservation of the transit of gas through Ukraine would be possible only in the case of Kiev competitive tariffs on transit and transit leveling known risks, including withdrawal of all claims and the abolition of the absurd claims of “Gazprom”.

In addition, the Russian foreign Ministry claim that the concept of construction of “Nord stream–2” does not imply the termination of transit of Russian gas through existing pipelines.

“These statements do not have faith. Last time we were also assured that the launch of “Nord stream-1″ will not lead to the reduction of transit through Ukraine. Deceived”, – said Yuri Vitrenko, the second part of the statement of the Russian foreign Ministry.

He recalled that recently the Russian side has stated publicly that under no circumstances will transit through Ukraine at the end of the current contract will not.

According to him, has changed this position only after Ukraine in the Stockholm arbitration demanded satisfaction of his contractual rights for revision of the transit tariff in compliance with the European conditions of the tariff. Yuri Vitrenko said that these conditions allow “Naftogaz” to demand a much higher transit fees to cover increased costs due to the need to rapidly amortize the Ukrainian gas transportation system.

“In other words, on the goodwill of Gazprom, we do not expect” – summed up the commercial Director of NAC.

As reported, in addition to claims of “Naftogaz” in the Stockholm arbitration the claim to “Gazprom” also has the Antimonopoly Committee of Ukraine. In January 2016 AMKU has fined “Gazprom” on the 85 billion UAH for abuse of a monopoly position in the market of transit of natural gas Ukraine. Then this decision was confirmed several times by the Ukrainian courts. Since that time the fine has increased to 172 bln UAH ($6.6 billion) due to the fines for his non-payment and Ukraine has started compulsory execution of the court decision on recovery of this amount.

Earlier it was reported that the restructuring of “Naftogaz” had almost stopped.
