Yanukovych was allowed to judge in absentia

Obolonskiy district court of Kyiv gave the go-ahead for specifically court proceedings treason of ex-President Viktor Yanukovych. This was stated by the presiding judge Vladislav Devyatko, reports 112.ua.

“The court established the following. Pursuant to part 3 of article 323 of the code of criminal procedure, judicial proceedings in criminal proceedings in respect of offences referred to in part 2 of article 297.1 of this Code may be carried out in the absence of the accused. If any such circumstances at the request of the Prosecutor, to which are attached the materials that the accused knew or should have known about the commencement of the proceedings, the court makes a determination on the implementation of the special judicial proceedings against such accused,” the judge said.

The court also recognized the disrespectful reason of the absence of former guarantor that he allegedly fears for his life in case of arrival to Kiev at the hearing. The judge stressed that Yanukovych took advantage of the opportunity to participate in the meeting via video link.

“Considering stated, being guided by article 323 of the code of criminal procedure, the court decided to conduct a special judicial proceedings against the accused Yanukovych for part 5 article 27, part 3, article 110, part 1 article 111, part 2 of article 437 of the criminal code. Determination not subject to appeal,” said Devyatko.

Recall that at the last hearing, on June 26, attorney Yanukovych Vitaly Seduc said that the defense has a statement about respectfulness of the reasons of absence of the suspect and insists on its participation in the hearing remotely.

In turn, the Prosecutor Kravchenko noted that the court three gave the suspect the opportunity to participate in the hearing, but the opportunity was not used. Therefore, according to him, there are all legal grounds for the decision on the implementation of the special judicial proceedings against Yanukovych, said the Prosecutor.

As you know, 14 March the Military Prosecutor’s office sent to court indictment against Yanukovych. According to the PGO, he is suspected of committing crimes under part 1 of article 111 (“high treason”), part 5 article 27, part 3 of article 110 (“Complicity in deliberate acts committed with the aim of changing the boundaries of the territory and the state border of Ukraine”) and part 5 article 27, part 2 of article 437 (“complicity in the waging of aggressive war”) the criminal code of Ukraine.
