Today at a closed session of the constitutional court of Ukraine judges of the CCU were unable to elect a new President of the court nor the release of their colleagues Yuri nos and Sergei Vdovichenko, who submitted the resignation.
This was reported by a source in the constitutional court.
In particular, according to the interlocutor of the Agency, to the office of Chairman of the CCU was considered the only candidate – Vladimir moysika, but she has not received the required number of votes, so the election of the President of the court is postponed.
Now, as of 3 June 2017 the acting President of KSU is Viktor Kryvenko, as the eldest judge of the COP, because as of this date expire powers of the present acting Chairman of the KSU nos that will just remain a judge of the constitutional court of Ukraine.
The nos, as well as the judge Vdovichenko, who submitted resignation, judges, CRS is now also unable to release, not enough of the necessary 12 votes.
The interlocutor of Agency has informed that one of the reasons that KSU did not accept the resignation of these judges, was a valid resolution of the Verkhovna Rada of Ukraine of February 24, 2014 “responding to the facts of violation by judges of the constitutional Court of Ukraine oath of judges”, according to which the Parliament, inter alia, invited the head of state to terminate the powers to dismiss judges of the CCU nos and Vdovichenko, who were appointed by the President of Ukraine in connection with violation of oath of judges. This resolution, the Parliament stated that they “violated the provisions of articles 3, 19, 147-153 of the Constitution of Ukraine, which is the failure to ensure the supremacy of the Constitution of Ukraine, violation of the duty to protect the constitutional order of the state, constitutional rights and freedoms of man and citizen and contradicts the oath of judges of the constitutional court of Ukraine, the honest and faithful performance of the duties of judges of the constitutional court of Ukraine”.
