The fight against uncleared cars: what to expect “Peresechenie”

According to statistics, in Ukraine about 50 thousand bonded cars, according to unofficial data – one and a half million. Every five days the Ukrainians with unregistered cars have to cross the border. Because of this, they are called “peresechnoe”. The owners of these vehicles articulate two reasons why they are not clearing the purchase of: high taxes and a ban on the import of cars older than 2010. The other day President Petro Poroshenko said that he would fight with the schemes of importation of cars with foreign registration. And in the Parliament to discuss a bill on the collection of two euros per day with the owners of such machines. Ukrainians buy cars with foreign numbers

In Europe, supported by foreign car sold for $ 2000 – $ 4000 in Ukraine for the same asking 8-10 thousand. On the Ukrainian sites ad hundreds of offers of “bonded sell the car.”

Ukrainians had every five days to cross the border, to create a scheme for registering a car in the Lithuanian or Polish company, and then sell. Not only citizens of Ukraine can legally drive a car with foreign registration. However, a foreign company may, by proxy to allow to use the car Ukrainian. One such company can be registered at 2000-3000 cars. Moreover, the car after the purchase remains the property of the company. The car can be confiscated or taken away through the courts, says Oleg Nazarenko, Director of the Ukrainian Association of auto importers and dealers. Residents of border areas who buy cars in Poland and other countries. Daily “Peresechenie” create queues at checkpoints. And sometimes they’re blocking the road or protesting at the Parliament with demands to extend the period of stay in Ukraine.

So, the border service of Poland has described the main cause of delays at checkpoints – fatal road infrastructure in Ukraine and hundreds of Ukrainians with the cars on the Polish rooms. However, the intention to deal with uncleared vehicles Petro Poroshenko. And on 26 may the President directed the Cabinet to resolve the situation with illegal cars and to improve customs legislation.

What awaits “Peresecina”

In the Verkhovna Rada are a few of the bills. So, in the Parliament registered draft law that propose to increase the length of stay of foreign cars. Bill No. 1393 increases the duration of transit for vehicles up to 30 days, the bill number 1393-1 to 60. Project No. 4473 proposes to collect for 408 UAH for the right to be bonded auto 30 days. Bill No. 2359а and No. 4223 allowed Ukrainian citizens to import a car with foreign registration year without additional requirements. Also in November 2016, the State fiscal service made to the relevant Committee of the Verkhovna Rada offer to split the customs fees of 0.25% of the car value per month. This stretched would pay taxes 33.3 years. However, experts have criticized this initiative because, according to them, the machine will have turned into scrap metal.

A similar idea for uncleared vehicles older than five years was announced by the people’s Deputy Vladimir Parasyuk. He suggested that owners of cars with foreign registration who do not meet eco-standards Euro-5 ‑ vehicles can not be clear in the legislation that is paid each year for 6000 UAH. To do this they will need to get a room with a special index.

Also, the Committee of tax and customs policy has recently recommended the Parliament to consider bill No. 4932. If it is accepted, drivers of cars on foreign registration have to pay two euros a day.

However, none of the bills proposes to reduce taxes for custom clearance. “When taxes are high people are looking for workarounds and deviate from the customs clearance of the car. The problem is not only with Lithuanian and Polish numbers. In Kharkiv and Sumy regions full of cars with Russian registration, as Russian cars are cheaper,” – says Oleg Nazarenko.

The owners themselves bonded car want not only tax reduction but also the abolition of the environmental standard Euro-5. He will not allow the import to Ukraine of cars produced before 2010. And from next year the country will enter into force Euro-6 – vehicles on this standard began to produce in 2015. “Peresechenie” mainly buy cars, outdated standards – they are two to three times cheaper. Ads Ukrainians for 1500-2000 dollars offer to buy uncleared cars 1997-2010.

“We propose to fix a concessional rate of excise duty adopted in the summer of 2016 on a permanent basis or to remove the requirement of Euro-5. And to introduce a tax Amnesty for cars that already ride transit. To give a possibility to clear of the vehicle at a reduced rate of excise duty”, – says Vasyl Antoniuk, the Deputy head of West-Ukrainian Association of transit car owners in Lviv.

The same problem exists in Moldova. But the government introduced a 70% discount on customs clearance of cars to combat illegal import of machinery from the EU.

As punish violators of the law

Lawyer customs law Olga Nikolayenko noted that the Ukrainian legislation allows to deal with illegal car fines and confiscation. However, there has been little interaction customs service and the police.

“The police can’t track what mode and on what grounds is one or the other car with foreign registration. There is a moral and ethical problem: we understand that citizens can and should use a cheap car, and on the other hand, there are international obligations and legal norms. Since the state took supine position – the problem with uncleared cars is increasing like a snow ball. Already, the owners of not cleared cars require special conditions. The law should be to draw up protocols and to confiscate such vehicles. All legally settled, but it does nothing”, – said the Executive Director of the Association “the Customs of the lawyers.”

Without registration to drive a car with foreign numbers, the Ukrainians can five days in one area and ten days, when movement in several areas. The alien to use uncleared machine can be no more than one year.

If your car is one day more than is necessary by the customs code, the driver faces a fine of 85 hryvnias. If the car stayed in the country from 1 to 10 days – will have to pay a fine of 3400 UAH, more than 10 days – 8500 hryvnia. If the car belongs to a foreigner, and driving Ukrainian – the car can be confiscated. And Ukrainians can be arrested in the case, if he refuses to pay the fine.

What threatens the Ukrainians who have violated the customs code:

  • The car stayed in Ukraine for a day – a fine of 85 hryvnias
  • From 1 to 10 days – a fine of 3400 UAH
  • More than 10 days – a fine of 8500 UAH
  • Refused to pay the fine – car arrest

If the foreigner has brought to Ukraine a car, and returned home without him, Ukrainian law enforcement agencies can apply in the country of the resident with the requirement to fine the offender. In addition, the machines without registration can be declared wanted.
