The judge of Solomensky district court of Kiev of Hell pedenko started to consider the petition of protection ex-the people’s Deputy Nikolay Martynenko disqualification of judge Alexander Bobrivnyk, the Chairman of the meeting on election of a preventive measure former MP.
At 20.15 Friday in the courtroom arrived pedenko, chosen by a system of automatic distribution of cases. At her request, the parties reiterate their arguments and counterarguments.
However, during a break in the court session on election of a measure of restraint ex-MP, 19.40 Friday, in the same hall and under the chairmanship of judge Bobrivnyk began consideration of the petition of prosecutors SAP of election of a measure of restraint to the second detainee in the case of damage or loss of PJSC “Odessa port plant” in the amount of UAH 205 million, the first Deputy Chairman of “Naftogaz of Ukraine” Sergey Fracture.
In the beginning of this meeting, the representatives of the protection of Fractures, some of which concurrently protect and Martynenko, said the withdrawal of judge Bobrivnyk and repeated the same arguments that were voiced in the statement about his disqualification in the case of election of a measure of restraint for former MP. Prosecutors who are also involved in both meetings reiterated their counterarguments.
Bobrovnik the judge also declared a break in session to transfer petitions for his disqualification for consideration by another judge of Solomensky district court of Kiev and withdrew from the courtroom.
Earlier on Friday, after a 4-hour delay, 18.54 judge Bobrovnik announced the beginning of the meeting. Immediately after this, the protection Martynenko filed a motion for his disqualification. The lawyer of the former MP argued the motion to dismiss the existence of a criminal proceeding in respect of Bobrivnyk, the availability of provocative material concerning him published on the Internet, and the choice of system of distribution of cases that is what the judge when considering high-profile cases of NABOO.
Martynenko supported the position of his lawyers to recuse a judge. Later adding that he knew in advance about what to consider, the case will be bobrivnyk. However, prosecutors said that the motion to dismiss is not based on any evidence.
After this, the presiding judge adjourned the case for transfer of the petition for his disqualification for consideration by another judge of Solomensky district court of Kiev and withdrew from the courtroom.
