The Cabinet of Ministers of Ukraine has allowed the employers to use labour of foreigners in several leadership positions and was obliged to conclude a contract with the employee-a foreigner within 90 days after obtaining work permits in Ukraine. This was reported by the press service of the Ministry of social policy.
The government has amended the procedure of issuing, extension and cancellation of permits to use labour of foreigners and individuals without citizenship.
So, the Cabinet has increased from 7 to 10 working days, the deadline for the submission of a copy of any agreement between the employer and the foreigner of the employment contract (contract) and the obligation of the employer to conclude an employment contract with a foreigner no later than 90 calendar days after the beginning of validity of the permit.
Also, employers are entitled to employ foreign expert in several leadership or management positions (part-time), which is important for enterprises created with foreign investment.
It is assumed, and define the procedure and terms of appeal of decisions of regional employment centers on the refusal to issue a permit, extension of its validity and annulment of the permit, and the Ministry will need to approve the appropriate procedure.
Introduces a provision on the refund to the employer the documents submitted for renewal of permit in case of failure of the regional employment center.
In this case, since the employment of foreigners in Ukraine creates competition for the citizens of Ukraine, remain the requirements for the protection of the national labour market from unskilled foreign labour force and provides that permission will be granted qualified foreign workers and only if there is no corresponding qualification of the unemployed registered in State employment service.
The report notes that the adoption act is to facilitate business, encourage employers to create jobs, the employment of vulnerable categories of citizens of Ukraine and improve the investment climate in the state.
