The head of the Specialized anti-corruption Prosecutor’s office (SAP) Nazar Golodnitsky announced the completion of the pre-trial investigation of criminal proceedings on embezzlement of public funds in the sum more than 336 million UAH allocated to Ukraine under the Kyoto Protocol.
As reported Holodnitsky on Friday on his page on the social network Facebook, on March 31, 2017 prosecutors SAP recognized sufficient collected during pre-trial investigation of the evidence for drawing up the indictment. The defense opened criminal proceedings.
“Collected materials it is established that the group of persons which structure included officials of GP “Crackernuts” by ensuring the victory of fictitious companies in tender procedures “Overhaul by retrofitting fixtures based on incandescent lamps based on LED technologies for reducing greenhouse gas emissions and improving the socio-economic conditions” made the attempted misappropriation of public funds amounting to over 336 million UAH”, – wrote Holodnitsky.
According to him, the results of pre-trial investigation of criminal proceedings against 10 people, including the Director of GP “Crackernuts” Smith V. reported suspected of committing crimes under part 2 of article 15 of part 5 of article 191 (attempted misappropriation of another’s property), part 2 of article 382 (contempt of court), part 1 St. 366 (forgery) of the Criminal code of Ukraine.
The sentences the courts have convicted two persons on the facts of fictitious entrepreneurship (part 1 of article 205 of the Criminal code of Ukraine).
Holodnitsky noted that based on the conclusion of judicial economic expertise set amount of funds, which had the opportunity to take possession of the attackers as a result of this criminal action, and currently is charged with the notification of suspicion − 336 million 009 thousand 811, 63 UAH.
As reported, 21 January 2016, the detectives NAB has made in the Unified register of pre-trial investigations the information under part 2 of article 15, part 5 of article 191 of the Criminal code on the fact of attempted embezzlement of the state funds in the amount of UAH 480 million allocated to Ukraine under the Kyoto Protocol. The attempt took place at the state enterprise “Ukrainian ecological investments” during the tender procedures for capital repairs of lamps with incandescent lamps based on LED technology. For involvement in the embezzlement of public funds NABOO checked all bidders.
In the course of criminal proceedings was arrested a number of persons, in respect of two was accepted convictions, the two announced a national search and one person in international.
January 31, 2017, the Director of the National anticorruption Bureau of Ukraine Sytnyk said that the investigation of criminal proceedings on the embezzlement of funds allocated under the Kyoto Protocol, is almost complete.
